Terms of Service
The rules that govern your use of AXO Email.
The agreement
By signing up for or using AXO Email ("the Service"), you agree to these Terms and our Privacy Policy. If you're using AXO on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Service is provided by AXO Email, Inc. ("AXO", "we", "us"). These Terms are a legally binding contract between you and AXO.
Your account
You must provide accurate information when creating your account. You're responsible for all activity that happens on your account, and for keeping your password secure. You must be at least 13 years old to use AXO. Business and Enterprise plans require that you're authorized to act on behalf of your organization.
Acceptable use
You may not use AXO to:
- Send spam, unsolicited bulk mail, or messages in violation of CAN-SPAM, CASL, or equivalent law.
- Phish, impersonate others, or deceive recipients.
- Distribute malware, ransomware, or exploits.
- Harass, threaten, or harm others.
- Violate intellectual property rights.
- Circumvent technical limits (rate limits, storage caps) or probe our systems without authorization.
- Engage in illegal activity under applicable law.
We may suspend or terminate accounts that violate these rules. For severe violations we may do so without prior notice.
Payment & billing
Paid plans are billed in advance, either monthly or annually at your chosen cadence. Prices are listed on our pricing page and may change with 30 days' notice. You authorize us to charge your payment method on each renewal.
Taxes (VAT, GST, sales tax) are added where applicable. We use Stripe to process payments.
If a payment fails, we'll retry over 7 days. If no valid payment is on file by day 7 after a failed charge, we'll suspend your account. Suspended accounts have 30 days to reactivate before data deletion.
Cancellation & refunds
All purchases are final. No refunds. By placing an order you acknowledge and agree that every charge — including domain registration fees, email hosting subscription fees (monthly or annual), WHOIS privacy add-ons, concierge setup, and any other paid services — is non-refundable. This applies whether you cancel after a day, a month, or eleven months into an annual term; whether you change plans; whether you stop using the Service; or whether we suspend or terminate your account for breach of these Terms.
You may cancel auto-renewal anytime from Settings → Billing. Cancellation takes effect at the end of your current paid-through period — you keep access until that date, and you will not be billed again. No prorated refund is issued for unused time.
Domain registrations are non-refundable in all cases because the registry fee is paid through our wholesale registrar at the moment of registration and is non-recoverable on our side. Once your domain is registered to your account you own it for the full registration term; you may transfer it away after the 60-day ICANN lock expires.
Refunds are issued only where required by applicable law (for example, certain consumer-protection statutes in your jurisdiction) or where AXO chooses, in its sole discretion, to issue a goodwill credit.
Chargebacks
Because all purchases are final and non-refundable, initiating a chargeback or payment dispute with your card issuer or bank for any AXO charge is a breach of these Terms. By placing an order you agree to contact AXO support first to resolve any billing concern.
If you file a chargeback for a non-refundable charge, AXO may:
- Submit our records — including your accepted Terms (timestamp + IP), order details, account login history, and proof of service delivery — as evidence to the card network.
- Immediately suspend or terminate your account and revoke access to the Service.
- Recover the disputed amount, any chargeback fees imposed by the card network or our payment processor, and reasonable collection costs and attorneys' fees, through collection action or legal proceedings.
- Refuse future service to you and any associated person or entity.
If a chargeback is later reversed in AXO's favor or withdrawn, the account will not automatically be reinstated; reinstatement is at AXO's sole discretion.
Your content
You own your mail, your contacts, and everything you store on AXO. You grant us a limited license to store, transmit, and display your content solely to operate the Service for you.
We don't claim any rights in your content beyond what's required to deliver the Service. We never use your mail to train AI models.
Availability
We monitor uptime continuously and surface live status on our status page. Scheduled maintenance is announced at least 72 hours in advance there. We're a young service and will publish formal uptime targets once we have a year of operating data to back them up.
If we fall below the target in a given month, Business and Enterprise customers may request service credits — open a ticket through our support form.
Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". EXCEPT AS EXPLICITLY STATED, AXO DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS CAPPED AT THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnity
You agree to indemnify AXO against claims arising from your violation of these Terms, your content, or your misuse of the Service.
Termination
Either party may terminate at any time. Termination for cause (your breach of these Terms) results in forfeiture of all prepaid fees, consistent with the Cancellation & refunds section above. Termination by you for convenience does not entitle you to a refund. If AXO terminates the Service in its entirety without cause (for example, a wind-down of the business), we will issue a prorated refund of the unused prepaid portion as our sole liability for that termination.
Disputes
These Terms are governed by the laws of the State of California, USA. Disputes are resolved by binding arbitration in San Francisco, California, under JAMS rules. Either party may bring small-claims actions in court. Class actions and jury trials are waived.
Miscellaneous
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. These Terms are the entire agreement between you and AXO. You can't assign this agreement; we can assign it in connection with a merger or acquisition.
